At the close of trial, parties filed their respective final written address. Collins Onyenwenu, a former (immediate past) Registrar of the 1 st defendant Polytechnic, testified as DW1 and tendered Exhibits DW1/1 to DW1/21.ģ. Ifenedo, a legal practitioner who works at the Delta State Polytechnic, Ugwasi-Uku as a staff/lecturer in the Department of General Studies, testified as DW and adopted his witness statement on oath dated 1 st December 2016 as his evidence in this suit. ![]() At the trial, the claimant testified on his behalf as CW and tendered Exhibits CW1 to CW23. G) The sum of ₦5 million being the cost of this action.Ģ. As per his originating process, the claimant is claiming against the defendants the following reliefs:Ī) A Declaration that the appointment/employment of the claimant subsists same having not been terminated in accordance with the terms and conditions of service for staff of Delta State Polytechnic, Ogwashi-Uku or the Law.ī) An order setting aside the report, findings and recommendation of the Joint Committee of Council and Academic Board of Delta State Polytechnic Ogwasi-Uku in respect of the claimant’s case.Ĭ) An order setting the termination of the claimant’s appointment/employment with the 1 st defendant.ĭ) An order reinstating the claimant to the service of the 1 st defendant and to the appropriate rank according to the terms of his employment as well as the promotions which he is duly entitled to if not for the unlawful acts of the defendants.Į) An order for payment of the claimant’s full salaries, arrears of salaries, promotion allowances, and other emoluments to which he is entitledį) The sum of ₦50 million being exemplary and aggravated damages for the unlawful acts of the defendants interdicting and terminating the claimant’s employment. The claimant upon receipt of the defendants’ statement of defence, also filed a reply to the statement of defence of 1 st September 2016. The defendants entered appearance and filed their defence processes. Executive Governor, Delta State was struck off this suit vide the application of M.O.Agwere, Esquire, Chief State Counsel, Delta State Ministry of Justice, which was not opposed by counsel to the claimant. By order of Court granted on 4 th December 2017, the 4 th defendant i.e. The claimant took out this action vide a complaint filed on 8 th July 2016 together with the accompanying originating processes.
